We will not allow the KABIRI® brand to be misused!
Unknown individuals are misusing the KABIRI® trademark to sell counterfeit rugs. Kabiri Carpet is taking legal action against these unfair commercial practices.
We have learned from various customers, members of the public and press reports that suspicious individuals are misusing our store’s protected KABIRI® trademark. Referring to our brand, they are selling textiles of unknown origin as oriental rugs in several districts of Budapest and in other parts of Hungary. They are conducting these sales from vans and passenger cars.
For more than 20 years, KABIRI® Carpet has offered authentic, high-quality hand-knotted oriental rugs, supported by a wide selection and a comprehensive range of related services. Our loyal customers, excellent references, reputation and good name have always obliged us to take every possible measure against counterfeit, unlawful and unfair commercial practices that harm buyers. This includes exercising our legal rights and claims for compensation under Act XI of 1997.
For clarity, we would like to briefly explain what trademark infringement involves:
“the infringement of the right of use arising from trademark protection, namely the unauthorised use, without permission, of the protected KABIRI® trademark in the course of commercial activity.”
The legislation lists the acts that are prohibited without the trademark owner’s permission, for example:
- places the KABIRI® logo on goods or their packaging,
- places the goods marked in this way on the market,
- uses or refers to the trademark when offering goods or services,
- imports or exports goods bearing the trademark.
